About the Scheme

The MAIB is governed by the Motor Accidents (Liabilities and Compensation) Act 1973 (Act).

This Act sets out the objectives, functions and powers of the MAIB, together with benefit eligibility criteria and types of benefits payable.

The Motor Accidents (Liabilities and Compensation) Regulatins 2010 (Regulations) to the Act quantify benefits payable by the MAIB and other conditions that may apply.

 

Extensive Coverage

 

Generally, all Tasmanians may qualify for MAIB benefits. In certain circumstances, non-residents of Tasmania may also qualify.

 

Motor vehicle owners must ensure their vehicle has an MAIB premium to qualify for benefits. Owners of uninsured vehicles can be liable for injury claims in the event of an accident.

  

Benefits

 

The MAIB provide a range of benefits which include:

 

a)  Reasonable medical costs, including the services of doctors and health professionals;

 

b)  Ambulance transport and hospital treatment;

 

c)  Allowances for loss of income, and the inability to perform housekeeping duties;

 

d)  Funeral Expenses;

 

e)  Death Benefits; and

 

f)  Reasonable travel costs to attend medical treatment (if more than 20km’s one way).

  

Common Law Action

 

Injured persons can take action to obtain damages under common law where the fault of another party can be established. An action must be commenced within three years of the date of the accident.

 

The majority of cases are settled without a court hearing.

 

Long Term Care

 

MAIB’s Long Term Care program is designed to provide appropriate lifetime care to the seriously injured. The program provides accommodation and care on a respite and longer-term basis in both the north, north-west and south of Tasmania (accommodation is available subject to availability and conditions). 

 

This program ensures appropriate care is provided to the severely injured.
